Cover Songs and Derivative WorksUpdated a year ago

A cover song is a new recording of a previously released song by another artist. While you own the recording of your cover version, the original composition (lyrics, melody, and structure) remains owned by the original composer(s).

Requirements for a Cover

To qualify as a cover, your recording must meet these guidelines:

  1. Lyrics
    • You cannot alter the song's lyrics in any way. Each word must remain exactly as in the original.
  2. Melody
    • You cannot change the melody. The tune should be identical to the original composition.
  3. Structure
    • You must keep the song’s structure the same. This means the order and sections of the song must follow the original layout.
  4. Distinct Sound
    • Your version should not closely imitate the original recording’s style or production. "Sound-alike" recordings—intended to mimic the original—are not permitted as covers.

A derivative work refers to any song created from an existing song that modifies the original lyrics or melody to produce a new composition. This is distinct from a cover song, which is a new recording of an existing song without changes to its lyrics or melody.

Key Differences Between Cover Songs and Derivative Works

  • Cover Song: Involves a new recording of an existing song without any changes to the lyrics or melody.
  • Derivative Work: Involves alterations to the lyrics, melody, or structure of the original song.

Examples of Derivative Works

Derivative works can include:

  • Remixes
  • Mashups
  • Translations
  • Interpolations
  • Parodies
  • Edited versions
  • Arrangements that alter the lyrics
  • Shortened or modified compositions

Distribution with JumpWave Group

You are not allowed to distribute a derivative work without obtaining permission from the copyright holder of the original composition. Unlike cover songs, copyright holders can deny permission for derivative works for any reason. We may contact you to provide documentation from the copyright holder.

Composition Credits for Derivative Works

If you have obtained proper licensing for a derivative work from the original publisher(s) or songwriter(s), you may distribute your version through JumpWave Group as an original work. Ensure that the credits reflect the licensing agreement you've negotiated with the original work's copyright holders.

Important Notes on Derivative Works

  • Derivative works cannot be licensed through the cover song licensing process.
  • To license derivative works, you can work with our partner providers like Easy Song or Affordable Song Licensing, which offer custom licensing services separate from those for cover songs.
